Terms & Conditions

These terms govern vehicle transportation brokerage services arranged through Carsfly Auto Transport.

MC 1690294 · USDOT 4329625 · Last updated September 2026
Important: Carsfly arranges transportation with independent motor carriers. Pickup and delivery dates are estimates unless a separate written guarantee expressly states otherwise.

1. Agreement to Terms

By requesting a quote, booking transportation, paying an amount toward a booking, electronically accepting these Terms, or signing a Carsfly transport agreement, the customer agrees to these Terms & Conditions and the shipment-specific booking confirmation.

2. Broker Role

Carsfly Auto Transport ("Carsfly," "we," "us") acts as a property broker arranging vehicle transportation with independent authorized motor carriers. Unless expressly stated in writing, Carsfly is not the motor carrier and does not operate the equipment that physically transports the vehicle. The assigned motor carrier controls the means and manner of physical transportation and is responsible for its drivers, equipment, and carrier operations.

3. Quotes and Pricing

Quotes are based on information supplied by the customer, route, vehicle details, transport type, timing, carrier availability, fuel and market conditions. A quote is not a guarantee that a carrier will accept the shipment at that amount. Carsfly will not materially increase the shipment price without customer approval. Additional charges may apply when the customer changes shipment details, vehicle condition, route, dates, vehicle dimensions, or other material information.

4. Carrier Assignment and Dispatch

Carrier assignment is subject to availability and carrier acceptance. Carsfly may communicate with carriers and customers to coordinate dispatch. The customer authorizes Carsfly to provide shipment and contact information reasonably necessary to arrange transportation.

5. Pickup and Delivery Dates

All pickup, transit, and delivery dates or windows are estimates unless Carsfly separately agrees in writing to a specific guaranteed service. Delays may result from weather, traffic, road conditions, mechanical issues, government requirements, hours-of-service limits, carrier scheduling, acts of God, or other events outside Carsfly's reasonable control.

6. Customer Responsibilities

The customer must provide accurate vehicle, route, contact, access, payment, and operability information. The customer must disclose modifications, oversized dimensions, low ground clearance, non-running condition, alarms, fluid leaks, or other conditions that may affect safe loading or transport. The vehicle must be available and accessible at pickup and delivery.

7. Vehicle Preparation

Before pickup, the customer should remove valuables and prohibited items, secure or remove loose accessories, disable alarms, maintain adequate battery and tire condition, and leave only the amount of fuel reasonably necessary for loading and unloading. The customer is responsible for keys required to operate and access the vehicle.

8. Personal Property

Personal property is not part of the contracted vehicle transportation service unless expressly accepted by the assigned carrier. Any permitted personal items may be subject to carrier limitations, weight restrictions, law-enforcement inspection, and insurance exclusions and are placed in the vehicle at the customer's risk.

9. Inspection, Bill of Lading, and Damage

The customer or an authorized representative should inspect the vehicle with the carrier at pickup and delivery. Existing condition and any delivery damage should be recorded on the carrier's Bill of Lading before the delivery receipt is signed. The customer should retain photographs and copies of all carrier documents.

10. Carrier Insurance and Claims

The assigned motor carrier is responsible for maintaining insurance required for its operations. Claims for loss or physical damage arising from carrier handling are generally handled with the motor carrier and its insurer. Carsfly will reasonably assist with carrier contact and documentation but does not replace the carrier's claims process or insurer. The customer must promptly report claimed damage and provide requested records, photographs, and the Bill of Lading.

11. Payment

The price, deposit, balance, and payment method displayed in the booking confirmation or signed agreement are incorporated into these Terms. The customer authorizes agreed charges through the selected payment method. Any balance due to the carrier must be paid as stated in the booking confirmation.

12. Cancellation and Refunds

Unless the booking confirmation states different terms, a customer who cancels before a carrier is assigned may request a refund of amounts collected by Carsfly. After a carrier is assigned, dispatched, or reserved for the shipment, a broker fee or deposit may become non-refundable to the extent permitted by applicable law because brokerage services have been performed and carrier capacity may have been committed. Carsfly may consider exceptions when a carrier fails to perform or other circumstances warrant adjustment. Any shipment-specific written cancellation term controls over this general section.

13. Failed Pickup, Inaccurate Information, and Additional Costs

If the vehicle is unavailable, materially different from the description, inaccessible, inoperable when described as operable, oversized, or otherwise requires services not disclosed at booking, additional carrier charges or rescheduling may be required. No material additional charge will be accepted by Carsfly on the customer's behalf without authorization when authorization is reasonably obtainable.

14. Electronic Communications and Signatures

The customer consents to transactional communications by email, phone, and text at the contact information provided, subject to applicable law. The customer agrees that electronic acceptance and electronic signatures are intended to authenticate the agreement and may be treated as the electronic equivalent of a handwritten signature.

15. Privacy

Carsfly may use and disclose customer information as reasonably necessary to quote, book, dispatch, process payment, communicate about, and support the shipment, including sharing relevant information with carriers and service providers.

16. Limitation of Broker Responsibility

To the extent permitted by law, Carsfly is responsible for the brokerage services it provides but is not responsible for independent carrier acts or omissions, physical handling of the vehicle by the carrier, or delays caused by circumstances outside Carsfly's reasonable control. Nothing in these Terms waives rights or remedies that cannot legally be waived.

17. Governing Documents and Severability

The signed Carsfly agreement, shipment-specific booking confirmation, these Terms, and applicable carrier Bill of Lading collectively govern the shipment. A shipment-specific written term controls if it directly conflicts with a general website term. If any provision is found unenforceable, the remaining provisions remain in effect to the extent permitted by law.

18. Contact

Questions about these Terms or a shipment may be sent to info@carsfly.net or directed to (888) 350-9320.

Legal review recommended: These Terms are a business draft prepared for Carsfly's workflow and should be reviewed by qualified U.S. transportation counsel before long-term production use, especially cancellation/refund, claims, dispute, and state-specific provisions.
